Hugo Parker Wins Summary Judgment For Farm
A freight broker arranged the shipment of HP’s client’s produce to retailer Walmart. Tragically, the trucker ran a stop sign and the resulting collision killed the driver of the other vehicle. Hugo Parker secured the dismissal of its client under the Federal Aviation Authorization Act (“FAAA”) which preempts negligence claims against a broker and its hirer, but allows the claims to proceed against a motor carrier.
