HUGO PARKER has challenged the constitutionality of a statute which expressly limits the number of hours that defense counsel can depose a mesothelioma plaintiff, while placing no time limit at all on the number of hours that plaintiff’s own counsel may depose the plaintiff, and which purports to strip the trial courts of their inherent and statutory authority to govern such depositions.  On June 25, 2021, in response to HUGO PARKER’s Writ Of Mandate/ Prohibition, the First Appellate District, Division Five, issued an ORDER TO SHOW CAUSE to Respondent Superior Court For Alameda and Real Parties In Interest ordering them to file a return to the petition on or before July 2, 2021.  The reply to the return is due on or before July 9, 2021 and oral argument is scheduled for July 15, 2021.
