HP Obtains Complete Defense Verdict For Asbestos Broker

On March 1, 2016, after a four-week jury trial in Stockton, California, James Parker obtained a defense verdict for HP’s client, a broker of raw asbestos (crocidolite) fiber. Plaintiffs asked the jury to award over $2 million in economic damages and an unspecified amount for pain and suffering against HP’s client, the only defendant at the time of the verdict.


Plaintiff Kris Moore had worked for several years in the early 1980s at the Johns-Manville plant in Stockton. He was diagnosed in 2015 at age 57 with pleural mesothelioma. He and his wife filed sued against a dozen defendants, but focused on the few years he had worked making transite pipe at J-M. Four defendants remained when trial started in late January in Department 13, with the Hon. Roger Ross presiding. All defendants resolved before plaintiffs rested, leaving only HP’s client.


The 5-man and 7-woman jury deliberated for a total of 3 1/2 hours before voting 12-0 on all three causes of action in favor of HP’s client.
